Prof Gerard Meussen and Dr Harm van den Broek of the Faculty of Law will give a lecture for interested members of the public on the financial compensation of victims of the Childcare Benefit Affair. They will discuss the origins and causes of the affair. What were the methods of checking for benefit fraud and how was discrimination involved? They also discuss the procedure and content of the current compensation scheme. Who is entitled to compensation, and how is its amount determined? 

Issues that will be discussed: 

  • When is there culpable action by the government? 
  • Why does the granting of compensation take so long? 
  • What situations fall outside the compensation scheme? 
  • What difficulties exist in compensating actual damages? 
  • What practical difficulties exist with 15-year-old cases? 
  • To what extent is mediation a good alternative here? 
  • Is the calculation of damages understandable for victims and lawyers? 
  • What exactly does the Catshuis scheme entail? 
  • What can the government expect from the 'doability' of those entitled to benefits? 
  • What are possible alternatives to the current system? 
  • What lessons can the government learn from the benefits affair?  
  • During the lecture, the audience will have the opportunity to ask questions to the speakers.
