Serge van der Slot is a PhD candidate at the Department of Private Law (Business & Law Research Centre). His research focuses on the role of employee participation in insolvency and seeks to develop a workable legal framework.
Restructuring and insolvency law often collide with employee participation rights, particularly when business operations are continued during bankruptcy. The insolvency practitioner must act in the interests of creditors, yet is also legally qualified as both an “entrepreneur” and a “director” within the meaning of the Dutch Works Councils Act (WOR), carrying corresponding obligations towards the works council. In practice, however, clear frameworks are lacking, regulation is fragmented, and case law is scarce. This dissertation explores how employee participation in insolvency can be shaped in a legally and practically workable manner, taking into account recent and future national and European legislation.
Serge holds a Master’s degree in Dutch Law with a specialization in Labour Law from Erasmus University Rotterdam.
