Carmen Schleijpen is researching the arbitrator's civil liability towards the parties to arbitration under current Dutch law. In her research, she analyses the position of the arbitrator versus the parties to the arbitration, examines the conditions for liability of arbitrators and identifies in relation to which types of errors the question of an arbitrator's liability might arise. Several concerns are addressed, including the scope and interpretation of the standard for arbitrator liability and the question of whether setting aside the arbitral award is a prerequisite for arbitrator liability.
