Jay Doerga is working on a dissertation with the working title 'Collectieve handhaving van het gegevensbeschermingsrecht'.
The literature assumes an enforcement deficit in data protection law. The regulator believes it is unable to take sufficient enforcement action due to a staff shortage, while it is rare for data controllers to bring proceedings against a data controller for violations of data protection law. The question is whether collective enforcement can close the enforcement gap in data protection law. In his doctoral research, Jay explores the extent to which collective enforcement can solve the enforcement gap in data protection law.
