In bankruptcy, too little money is available to pay all creditors. In such a situation, there is a multitude of interests involved, sometimes parallel, and sometimes opposing. This is a source of conflicts that can hinder the efficient and effective resolution of bankruptcy. Jim explores whether alternative forms of dispute resolution, and mediation in particular, can be a solution. He discusses the possibilities of mediation during bankruptcy, but also its limitations. To do this, Jim conducts literature research and interviews with receivers, mediators and judges, among others.
