1. Use of parking lot
1.1 Parkers will observe traffic regulations and safety both on campus and in the parking lots and follow any directions given by Parking Management.
1.2 Parkers are only authorized to enter the parking lot with a motor vehicle if subscriber is in possession of a valid Proof issued by Radboud University. The parking lot may only be used for the temporary (less than 24 hours) parking of a motor vehicle and not for other purposes such as, for example, parking a caravan or camper.
1.3 The Car Park User may only enter and exit the Car Park during the opening hours indicated in or near the Car Park and/or on the website or at times agreed upon.
1.4 Radboud University is entitled to refuse certain motor vehicles if Radboud University considers this desirable with due regard for reasonableness and fairness. Such refusal will occur in particular if Radboud University knows or suspects that the motor vehicle may cause damage (in the broadest sense).
1.5 The parking customer is prohibited from:
- using the parking space for purposes other than parking;
- offering, selling, renting or distributing goods or services in, on or near the parking lot;
- bringing or having explosive, flammable or otherwise hazardous and/or noxious substances in the parking lot, except motor fuels in the fuel tank of the motor vehicle;
- to make or affix advertising and/or other signs on or near the parking lot;
- to carry out or have carried out repairs to the motor vehicle or other work in or on the parking lot, unless expressly permitted by or on behalf of Radboud University;
- staying in the motor vehicle longer than the time required to park the motor vehicle in question;
- to park in a parking space that is distinctively designated for a specific (type of) motor vehicle (such as a license plate parking space, disabled parking space, a parking space with an electric charging station or a car or motorcycle parking space) with a means of transportation other than the specific (type of) motor vehicle designated for that purpose;
- driving out of the parking lot directly behind another motor vehicle past the barrier without the barrier having been closed in the meantime ("train driving").
1.6 If parking customer violates the above provisions in 1.5.1 to 1.5.8, Radboud University is entitled to deny parking customer access to the parking space, without prejudice to any other rights for Radboud University resulting from the non-compliance.
1.7 Radboud University is entitled, if in the opinion of Radboud University this is necessary, to move (or cause to be moved) motor vehicles in the parking lot at the expense of the parker, to provide (or cause to be provided with) a wheel clamp and/or to remove (or cause to be provided with) any motor vehicle from the parking lot, without this leading to any liability on the part of Radboud University. Radboud University will observe reasonableness and care in assessing the need for any of the aforementioned measures.
1.8 If a parking space has the facility for electric charging of a motor vehicle, the parker, if he/she has a motor vehicle suitable for this purpose and corresponding suitable charging card, may make use of this service, if available. Radboud University in no way guarantees the availability and usability of such charging point. Radboud University is never liable for any damage resulting from use of the charging point. An electric motor vehicle may only be parked in a parking space with an electric charging point during the time the motor vehicle is actually connected to the charging point. Radboud University is entitled to charge an (additional) rate for the period that the motor vehicle connected to the charging point remains parked in the parking lot with electric charging point after the car has been charged. These rates will be posted on the website and/or in the parking lot.
2. Privacy
2.1 When entering a number of parking spaces on the Radboud University grounds, your license plate number will be registered for the purpose of determining the parking duration and calculating the parking fee due. This is indicated at the parking spaces where this applies. Otherwise, these data are not stored and no special or sensitive personal data are processed.
3. Liability and indemnification
3.1 Parking is at the expense and risk of the parker. No camera recordings will be made in the parking areas.
3.2 Radboud University shall not be liable for damage of any kind incurred, inflicted or otherwise suffered by or to subscriber or third parties as a result of parking on campus (unless the damage is due to intent or gross negligence of Radboud University).
3.3 Parking subscriber shall indemnify Radboud University against any claims of third parties who suffer damage and the cause of which is attributable to parking subscriber. If Radboud University should be sued by third parties on that account, the parking customer shall be obliged to assist Radboud University both extrajudicially and judicially and to immediately do all that may be expected of the parking customer in that case. Should parker fail to take adequate measures, Radboud University shall be entitled, without notice of default, to take such measures itself. All costs and damage on the part of Radboud University and third parties resulting therefrom shall be fully at the expense and risk of the parking customer.
4. General
4.1 These regulations apply to every parking space at Radboud University. Radboud University is entitled to unilaterally amend these regulations. Amendments shall take effect four weeks after publication or on a later date specified in the publication.
4.2 Access to the parking lot is granted only under the application of these these regulations.
4.3 If the interpretation of one or more provisions of these regulations is unclear or if a situation arises that is not provided for in these regulations, it must be interpreted 'in the spirit' of these provisions.
4.5 If Radboud University does not always require strict compliance with these regulations, this does not mean that the provisions thereof do not apply or that Radboud University would in any way lose the right to require strict compliance with the provisions of these regulations in other cases.
