Compensation scheme Works Council

Radboud University Nijmegen has adopted the following regulations with effect from 1 September 2025.

Article 1  

  1. The following compensation shall be granted to the organisational unit whose employees have been elected to the Works Council (OR): 
    a. for the chair: 0.5 FTE;
    b. for the secretary: 0.4 FTE; 
    c. for the vice chair: 0.3 FTE;
    d. for the other members of the OR: 0.2 FTE.
    e. For representatives from the UMC Council of Radboud University Medical Center who are part of the University Joint Assembly (UGV) of Radboud University Nijmegen, compensation of 0.2 FTE shall be provided.
  2. In the event that there are more than three OR members participating in the OR’s Executive Management, the 1.2 FTE granted in total as compensation under paragraph 1(a), (b) and (c) of this article can be divided among the members of the OR’s Executive Management as seen fit.
  3. Compensation shall be calculated based on the actual salary of the employee elected to the OR.
  4. The compensation must be spent on replacing the employee for whom compensation is provided or on support with progressing that employee’s work or on temporarily extending weekly duties for the duration of the term of office if an OR member works part-time. The supervisor shall consult with the employee on use of the compensation and shall then make a decision on this, taking into account the employee’s wishes as much as possible. A temporary extension of weekly duties if an OR member works part-time shall be possible only if the number of hours constituting full-time employment is not exceeded.
  5. In accordance with the provisions of the Works Councils Act (WOR), the employer must take such measures and/or make such provisions as members of the OR may reasonably require for performance of their duties as OR members. 

Article 2

  1. Notwithstanding the provisions of Article 1, the chair’s fixed-term employment contract may be extended by 0.5 FTE for each year that the employee holds the position of chair, regardless of the part-time ratio.
  2. Notwithstanding the provisions of Article 1, the secretary’s fixed-term employment contract may be extended by 0.4 FTE for each year that the employee holds the position of secretary, regardless of the part-time ratio.
  3. Notwithstanding the provisions of Article 1, the vice chair’s fixed-term employment contract may be extended by 0.3 FTE for each year that the employee holds the position of vice chair, regardless of the part-time ratio.
  4. Notwithstanding the provisions of Article 1, the fixed-term employment contract of a member of the OR may be extended by 0.2 FTE for each year of membership of the OR, regardless of the part-time ratio.
  5. In the event that there are more than three OR members participating in the OR’s Executive Management and the 1.2 FTE granted in total as compensation under Article 1 is divided among the members of the OR’s Executive Management as seen fit, this subdivision shall also apply to paragraphs 1, 2 and 3 of this article.
  6. Extension of the employment contract pursuant to paragraphs 1, 2, 3 and 4 of this article shall be possible only if this does not lead to the formation of an employment contract for an indefinite period by operation of law. If extension of the employment contract is not possible on this basis, Article 1 of these regulations shall apply.
  7. The provisions of paragraphs 1, 2, 3 and 4 of this article shall apply for the period from 1 September 2025 to 31 December 2028. 

Explanation

Under the ‘Agreement on Decentralised Employment Conditions Funds 2024-2028’, only the extension of a fixed-term employment contract shall be financed using decentralised employment conditions funds. Compensation for the replacement of OR members who have employment contracts for an indefinite period shall be covered by a designated central budget. 
The number of hours by which a fixed-term employment contract can be extended should be calculated on the basis of the working hours stated in the Collective Labour Agreement.
