Title Immigration Judges and Children’s Rights – How judges decide cases on residency when children are involved
Description Children’s rights have in recent year increasingly permeated the European legal order. Especially in the context of family migration this development has had a significant impact. As a consequence, national courts are faced with the task of reconciling the rights and interests of the child with the right of the State to control its borders. The present research investigates how courts conduct this task by examining the role and meaning of children’s rights in judicial immigration decisions by Dutch and German courts.
