This research studies the transposition of Article 16 (the competence to withdraw, reduce or refuse reception facilities) and Article 21 (right to judicial protection against those decisions) of the Reception Directive in The Netherlands, France and the United Kingdom. Are these provisions transposed in national (administrative) law of the indicated Member States? The research studies the procedural conditions which EC law and the ECRM prescribe in case a decision based on Article 16 is taken and the obligations of the MemberStates under EC law and the ECRM in organising judicial protection and control. The research should answer the question whether the Member States follow those obligations and if the transposition of the indicated provisions of the Directive leads to differences between the member states. |
