Title | Leaving, Entering, and Remaining: Seeking Asylum in an Extraterritorial World |
Description | This research focusses on the legal validity of the extraterritorial processing of asylum claims by the EU from the perspective of Natural Law Theory. As a result, it considers aspects of morality and legal positivism when assessing legal validity. In particular, the thesis is built around the argument that the principle of protection as enshrined in International Refugee Law is a moral obligation which the EU should be bound by when considering new ways in which to structure its asylum processing systems. The thesis then compares the current territorial system of asylum with the proposed extraterritorial system of asylum processing in order to determine whether the principle of protection is still ensured. |
