Regulations

Article 1. Purpose

  1. The Ethics Assessment Committee Law and Management (EACLM) aims to ensure that externally funded research conducted within the Faculty of Law (FoL) and the Nijmegen School of Management (NSM) is carried out in accordance with the ethical guidelines of the funding agency and in line with common ethical standards.
  2. The objectives of the EACLM are:
  3. To inform and advise the (potential) research applicant about the ethical acceptability of research proposals;
  4. To conduct ethical reviews of research proposals.

Article 2. Composition

  1. The EACLM comprises at least three members, representing both faculties (FoL and NSM). At least one of the members is an independent ethics expert.
  2. The other two members are members of the scientific boards of both faculties.
  3. All members of the EACLM enjoy an unblemished reputation in terms of research ethics and academic integrity.
  4. The chairperson and the members are appointed for a period of two years. Reappointment for a consecutive period of two years is possible, with a maximum of two such reappointments.
  5. Members of the EACLM shall appoint a chairperson for a period of two years. The chair rotates between FoL and NSM.
  6. The members are appointed by the boards of both faculties. The board of a given faculty shall appoint the committee member of the same faculty.
  7. The composition of the EACLM may be supplemented with other members invited to sit for a shorter duration, when specific expertise is required.
  8. When an EACLM member is substantially involved in a research proposal discussed in the EACLM, this member shall not participate in the discussion of said proposal. In such situations, an external member shall be appointed as a substitute.
  9. The Committee is assisted by a secretary and by secretarial support. The secretariat shall rotate between FoL and NSM.

Article 3. Procedure

  1. The EACLM meets at least twice a year on predetermined dates.
  2. The EACLM informs and advises on the ethical acceptability of research proposals, based on general guidelines for responsible research [1] and in accordance with the ethical guidelines of the research proposal’s funding agency.
  3. The Committee may arrive at three different types of advice, namely: agree; agree subject to limited modification of the proposal; or do not agree.
  4. The EACLM shall decide unanimously as a rule. In the event that the EACLM is unable to decide unanimously, the Committee shall act by a simple majority.
  5. All members, external experts and the secretary shall be required to observe strict confidentiality in respect of all Committee proceedings.
  6. The EACLM shall inform the applicant of its ethical advice, but is not responsible for incorporating the advice in the research proposal. The applicant remains responsible for processing the research proposal.
  7. In the event that the applicant does not agree with the advice of the EACLM, the Dean of the applicant’s faculty shall decide on the ethical applicability of the research plan.
  8. The requirements for the submission of a research proposal for ethical review have been described and published on the EACLM website.
  9. The secretary to the committee shall send notification of receipt within four (4) working days after receipt of the application and shall inform the applicant of the period within which the application shall be handled by the EACLM.
  10. The outcomes of the application after the EACLM’s assessment shall be reported to the applicant by e-mail within four (4) working days of the EACLM’s meeting. Any delay shall be communicated to the applicant. The written advice of the EACLM shall be sent to the applicant no later than fifteen (15) working days after the date of the meeting. The EACLM’s opinion shall be made available to the funding agency and to the applicant’s faculty board.
