Aims
Learning Targets:
 
  • The student acquires a profound knowledge of the main positions within an ethical approach to law.
  • The student acquires a profound knowledge of some of the controversies in contemporary ethical, political and legal life.
  • The student is able to analyze the argumentative structure of classical philosophical texts and is able to reproduce this structure.
  • The student is able to write a small paper in the philosophy of law.
  • The acquired knowledge and cognitive skills enable the student to reflect on positive law and legal practice.
Content
This course offers an introduction into contemporary philosophy of law/ ethics.
The basis of the course consists of the world famous 'Justice' book by well-known philosopher Michael Sandel. During the course a close reading of this book will be complemented by the reading of a variety of classical texts by authors such as Aristotle, Locke, Kant, Bentham, Rawls, Nussbaum and some classical cases such as Brown v. Board of Education, Roe v. Wade. The main theories discussed will be utilitarianism, deontology and virtue ethics.

The course will consist of two hours of seminar per week. Students must have read and prepared the compulsory reading for each week and participate on that basis. Preparation, attendance and participation are compulsory.
