In this seminar we hope to bring together different approaches to the study of immigration law, the position and portraying of the undocumented migrant, and the legal study of present-day immigration policies, using Legomsky’s Article on the Undocumented Migrant (Georgia Law Review 2009, p. 1-96) as a starting point for discussion.

The Article by Legomsky suggests that the great divides on both the factual impact of illegal immigration and the preferred policy responses have been driven largely by differences over a fundamental question that the literature has surprisingly neglected:

Who is the undocumented immigrant?

Legomsky tries to draw the divergent conceptual portraits of the undocumented immigrant that have shaped the opposing arguments in modern debates on this subject.
But is there a difference between the conceptual portrait of the undocumented immigrant in the USA and in Europe?

After an introduction by Stephen Legomsky, four discussants are invited to reflect on Legomsky’s statements from various perspectives.
